1. Acceptance of Terms
These Terms govern access to and use of Marketing Paths, including the website, application, software, dashboards, AI-assisted tools, WordPress connector, publishing workflows, affiliate campaign tools, community areas, support channels, templates, automations, and related services. By visiting the website, creating an account, starting a subscription, connecting a third-party account, or using the platform, you agree to these Terms and all policies referenced by them.
If you use Marketing Paths on behalf of a business or other entity, you represent that you have authority to bind that entity, and “you” includes both you and that entity.
2. Accounts and Eligibility
You must provide accurate account information, maintain the security of your login credentials, and promptly update information that becomes inaccurate. You are responsible for all activity under your account, including activity by team members, contractors, clients, or anyone with access through your credentials.
Marketing Paths may refuse registration, suspend access, require verification, or terminate accounts where we believe there is a legal, security, payment, fraud, abuse, reputation, or policy risk.
3. Subscriptions, Billing, Trials, and Cancellation
Paid features may require an active subscription or other paid plan. Pricing, renewal terms, plan limits, trial terms, taxes, cancellation options, and refund rules may be displayed at checkout, inside the app, or in a separate written agreement. Unless expressly stated otherwise or required by law, fees are non-refundable once access has been provided.
You authorize Marketing Paths and its payment processors to charge applicable fees, taxes, renewal payments, upgrades, and other amounts associated with your plan. Failure to pay may result in downgrading, suspension, loss of premium features, or termination.
4. License to Use the Platform
Subject to these Terms, Marketing Paths grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the platform for your internal business or personal marketing purposes. We reserve all rights not expressly granted.
5. User Content and Permissions
You retain ownership of content you submit, upload, import, generate, edit, publish, or store through Marketing Paths, subject to any rights held by third parties. You grant Marketing Paths a worldwide, non-exclusive, royalty-free license to host, process, reproduce, transmit, display, analyze, modify, generate from, and otherwise use your content as necessary to provide, secure, support, and improve the services you request.
You represent that you have all rights, permissions, consents, licenses, and authority needed for the content, data, links, images, claims, trademarks, connected accounts, and publishing actions you use with Marketing Paths.
6. AI-Assisted Output
Marketing Paths may provide AI-assisted recommendations, drafts, outlines, keywords, images, titles, articles, social posts, disclosures, analytics, workflows, and other output. AI output is not guaranteed to be accurate, unique, complete, lawful, non-infringing, compliant, or suitable for your purpose. You are solely responsible for reviewing, editing, fact-checking, approving, and legally clearing all output before use.
Marketing Paths does not guarantee that AI output will improve rankings, traffic, leads, conversions, commissions, revenue, approvals, or business results.
7. Integrations and Publishing Actions
When you connect WordPress, Facebook, Meta, or another third-party platform, you authorize Marketing Paths to access and perform actions you request through that connection, including reading permitted data, saving settings, checking status, uploading media, and publishing or updating content. Third-party platforms are not controlled by Marketing Paths, and their availability, rules, APIs, approvals, fees, limits, and data practices may change at any time.
You are responsible for complying with each connected service’s terms, policies, permissions, disclosure rules, content rules, and account requirements.
8. Prohibited Conduct
You may not use Marketing Paths to break the law, infringe rights, spam, deceive, defraud, harass, exploit, distribute malware, scrape without authorization, bypass technical limits, interfere with systems, reverse engineer the platform, resell unauthorized access, share accounts improperly, publish prohibited content, or violate the Acceptable Use Policy or Community Guidelines.
9. Affiliate, Advertising, and Regulated Content
You are responsible for all claims, testimonials, endorsements, reviews, affiliate links, disclosures, income statements, health statements, financial statements, legal statements, and other regulated or sensitive content you create or publish. The FTC has guidance for endorsements and affiliate disclosures, and users are responsible for making clear and lawful disclosures where required.
10. Intellectual Property of Marketing Paths
The platform, software, interface, workflows, designs, logos, copy, templates, documentation, code, databases, systems, and other Marketing Paths materials are owned by Marketing Paths or its licensors and are protected by intellectual property and other laws. You may not copy, modify, distribute, sell, lease, exploit, or create derivative works from the platform except as expressly allowed in writing.
11. Service Changes, Availability, and Beta Features
Marketing Paths may add, modify, restrict, suspend, or discontinue features at any time, including for security, legal, operational, performance, platform, or business reasons. Features may be unavailable due to maintenance, outages, third-party failures, API changes, internet disruptions, or events outside our control.
Beta, experimental, or preview features may be changed or removed at any time and may be less reliable than generally available features.
12. Suspension and Termination
We may suspend, limit, or terminate access immediately if we believe you violated these Terms, failed to pay, created risk, misused the platform, infringed rights, threatened security, violated law, or exposed Marketing Paths, users, providers, or third parties to potential liability. You may stop using the service or request account deletion according to our Account Deletion page.
13. Disclaimers
Marketing Paths is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.
14. Limitation of Liability
To the maximum extent permitted by law, Marketing Paths and its owners, officers, employees, contractors, agents, providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, punitive, lost-profit, lost-revenue, lost-data, reputational, business-interruption, or substitute-service damages, even if advised of the possibility.
To the maximum extent permitted by law, any total liability arising from or related to the service will not exceed the amount you paid to Marketing Paths for the service giving rise to the claim during the three months before the event giving rise to liability, or one hundred dollars if no paid subscription applies.
15. Indemnification
You agree to defend, indemnify, and hold harmless Marketing Paths and its owners, officers, employees, contractors, agents, providers, and affiliates from claims, damages, losses, liabilities, penalties, costs, and expenses, including reasonable attorneys’ fees, arising from your content, campaigns, connected accounts, publishing actions, violation of these Terms, violation of law, infringement of rights, or misuse of the platform.
16. Governing Law and Disputes
Unless a separate written agreement states otherwise, these Terms are governed by the laws of the state and country where Marketing Paths is operated, without regard to conflict-of-law rules. Any dispute must be brought in a court with proper jurisdiction unless the parties agree in writing to another process.
17. Updates to Terms
We may update these Terms by posting a revised version. Continued use of Marketing Paths after changes become effective constitutes acceptance of the revised Terms.
